AFFIDAVIT IN EXPARTE PROOF

           AFFIDAVIT IN EXPARTE PROOF

        I, Mst.ShahmaD/oImam Bux  Muslim, adult by caste Khoso R/o Hussainabad Colony  dadu Town District Dadu, do hereby state on oath as under :-

1.                 That my my marriage  was solemnized with defendant about 6 years ago  according to sunni sect of Islam and the Nikahnama was  not registered.
2.                 That out of this wedlock no issue was born.

3.                 That at the time of marriage the defendant promised to give cash Rs.5000/- as Haq mahar  but the same was not given to me in spite of my repeated demands.

4.                 That after one year of marriage, the defendant began to ignore me, did not maintain me properly and used to beat me.

5.                 That in the month of January 2013, the defendant had set me ablaze and I was rescued by the neighbours and was taken to hospital.

6.                 That hearing the incident my mother came to me in the defendant house and brought me in her home in johi.



7.                 That thereafter the gentlemen of the area intervened and then the defendant took me to his home.

8.                 That after 06 months of my stay in the Defendant house, the defendant repeated the acts of ignorance, non-maintenance and torture to me throughout the period of my stay with the defendant, I endured  ill-treatment with me by the defendant with great fortitude.

9.                 That I in the hope of adopting better behavior by the defendant with me, tolerated all the ill-treatment but my hopes were defeated.

10.            That on the morning of 23-05-2016, the defendant gave me severe beating and ousted me from his home in three clothes. I called my mother and narrated her the whole story further saying that I was standing in Naushehro Feroze all alone helpless and destitute.

11.            That my mother came alongwith my minor brother Irfan aged eight years to Naushehro Feroze and brought me back in her home in johi.

12.            That due to inhuman and degrading  treatment with me by the defendant, I have created hatred and abhorrence in my mind for the defendant hence I am not ready to live with the defendant as his wife, so  I have preferred to file the instant suit for dissolution of marraiage with the defendant on the ground of Khhulla in this Honorable Court with prayer that my marriage with the defendant may be dissolved on the ground of Khulla.


13.            That whatever is stated above is true and correct to the    best of my knowledge and belief.
